2. Application of the General Terms and Conditions of Sale
These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") define the terms of sale between the company Philippe Tayac and the Customer, within the framework of a distance selling system on the Internet and mobile, for the goods defined in the online catalogue of the site (hereinafter referred to as the "Site").
These conditions apply to the exclusion of all other conditions, including those in force for sales in stores or on other media.
The terms and conditions are made available to each customer to allow them to place an order with complete transparency.
Placing an order on the Site (filling the basket) and confirming this order (validating the basket) implies full and complete acceptance of these Terms and Conditions, which will be the only ones applicable to the contract thus concluded.
Philippe Tayac reserves the right to modify all or part of these Terms and Conditions at any time and without notice.
3 · PRODUCTS AND ITEMS
The products offered to the Customer are those listed in the catalogue published on the Site, subject to availability and the proper functioning of the Site.
Each product is presented with a photograph and a description specifying its essential characteristics. These descriptions are provided for informational purposes only and are not contractually binding.
The visuals and photographs aim to present the products as faithfully as possible, without guaranteeing perfect similarity, due in particular to the handcrafted nature of the creations.
4 · ORDER
Placing an order on the Site requires the creation of a Customer Account by entering two identifiers: an email address and a password. These identifiers are and must be kept confidential. The Customer may request access to their identifiers by contacting Croccante's Online Customer Service, which will respond only by email to the address used when creating the Customer Account.
The Customer agrees to complete the order form accurately and to fill in all the required fields (full name, billing and shipping address, payment method, etc.). After payment, they will receive an email confirming the details and terms of their order. The order is only valid once all the information requested from the Customer has been provided.
By clicking the "Pay" icon on the website, the customer acknowledges having the full legal capacity to enter into a contract under these General Terms and Conditions of Sale, which are the only terms applicable to the subsequent contract. The website is accessible to the customer 24 hours a day, 7 days a week, except during maintenance periods. Before paying for the order, the customer declares having read and accepted these General Terms and Conditions of Sale. Order confirmation therefore constitutes unreserved acceptance of these General Terms and Conditions of Sale.
For any modification or cancellation of order, the Customer must contact the Internet Customer Service no later than the day before collection before 4pm: by email contact@philippetayac.com or by phone 0497107401 No refund will be given.
The company reserves the right to refuse an order if the customer fails to meet any of their obligations and, more generally, to refuse any order that is abnormal or incomplete for any reason whatsoever. The order is only final after confirmation by SAS Philippe Tayac. SAS Philippe Tayac will confirm acceptance of the order to the customer by email or, if applicable, its refusal within 48 business hours of the order being placed online.
5 · PRICE
The prices shown on the website are in Euros, inclusive of all taxes. They include French VAT at the rate in effect on the date of the order. Prices displayed on the website may be changed at any time and will be immediately updated. The new prices will apply to all orders placed after they are published online.
6 · METHOD OF PAYMENT
Online payment is made by VISA or MASTERCARD credit card. Depending on the card type, the customer must enter their card number, expiry date, and security code, and then confirm this information. The customer agrees to use the credit card of which they are the cardholder. In the event of fraudulent use, the seller cannot be held liable. All credit card holders are subject to validation checks and authorization by the issuing bank. If the issuing bank refuses payment authorization, the order will not be accepted. In this case, the seller will not be responsible for any delay or refusal to fulfill the order. The seller is not responsible for any fees charged by the issuing bank for credit card payments. To be processed, the order must be submitted in its entirety. Any unpaid order will not be fulfilled. The products remain the property of the seller until full payment has been received by the seller.
7. RIGHT OF WITHDRAWAL
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to the following products:
• Goods made to the consumer's specifications or clearly personalized
• Fresh or perishable products, including macarons, pastries, viennoiseries, chocolates, confectionery, ice cream, sorbets, and drinks.
• Products unsealed after delivery for hygiene or health protection reasons.
For other products, the Customer has a period of fourteen (14) days from receipt to exercise his right of withdrawal, without having to justify reasons or pay penalties, provided that the products are returned in their original condition and packaging, accompanied by the purchase invoice.
Return shipping costs are the responsibility of the customer.
Refunds or exchanges (subject to availability) will be processed within 14 days of receiving the returned products.
8. Product Availability
Product offers are valid as long as they appear on the Site and while stocks last.
In the event that a product is unavailable after the order has been validated, SAS Philippe Tayac will inform the Customer as soon as possible and will offer, as appropriate, cancellation and refund of the order.
9 · DELIVERY CONDITIONS - IN-STORE PICKUP
The products are available:
• For in-store pickup at Maison Philippe Tayac, according to the time slots indicated when ordering.
• For delivery, according to the service areas specified on the Site.
Delivery times are given as a guide and may vary depending on transport or supply conditions.
SAS Philippe Tayac cannot be held responsible for any delay due to force majeure or an event beyond its control (bad weather, strikes, transport incidents, etc.).
The Customer agrees to check the condition of the package upon receipt.
Any anomaly (missing or damaged product, etc.) must be reported within 24 hours to the following address: contact@philippetayac.com
Any order placed the day before by 5:30pm can be collected in store no earlier than the next day at 10am (depending on the opening days of the selected store).
10 · CLAIMS AND REFUNDS
Any complaint regarding a product must be made in writing (email or letter) within 48 hours of delivery or collection.
No claims will be accepted after this period.
Any refunds will be made after verification and validation by the quality department of SAS Philippe Tayac.
No product that has been consumed, opened or damaged after delivery will be eligible for a refund or exchange.
11 · PRODUCT QUALITY
The seller guarantees to the customer that the products are manufactured and packaged according to strict quality and hygiene standards and stored in accordance with French regulations. Should the customer fail to comply with the optimal storage conditions or expiration dates, the seller cannot be held liable for any deterioration in the quality of the products. All items offered on the website are subject to the legal guarantee against hidden defects and flaws that may affect the products, as stipulated in Article 1641 of the French Civil Code.
12 · INTELLECTUAL PROPERTY
All elements of the Site — texts, photographs, logos, illustrations, trademarks, design, videos and sounds — are the exclusive property of SAS Philippe Tayac.
Any reproduction, representation, adaptation or exploitation, in whole or in part, on any medium whatsoever, without prior written authorization, is strictly prohibited.
Any violation will be prosecuted in accordance with the Intellectual Property Code.
13 · DATA PROTECTION
PERSONAL DATA
SAS Philippe Tayac collects and processes the personal data of its Clients in strict compliance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.
The information collected is necessary for order management and communication with the Customer.
They are never shared with third parties for commercial purposes.
The Client has the right to access, rectify, delete and object to the processing of their data at any time, by sending a request to:

14 · INDEPENDENCE OF CLAUSES
If any provision of these Terms and Conditions is deemed invalid or unenforceable, the other provisions shall remain in full force and effect.
The fact that SAS Philippe Tayac does not invoke a breach of any of the obligations mentioned in these General Terms and Conditions shall not be interpreted as a waiver of the obligation in question.

16 · APPLICABLE LAW
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, and failing an amicable agreement, the competent courts will be those of the jurisdiction of the registered office of SAS Philippe Tayac, unless otherwise provided by public policy.
